While the Public Trust Doctrine (PTD) was traditionally applied to tidelands, seashores, and the bed and banks of surface waters, more recent applications have focused on the water resource itself. The PTD is rooted in protecting common resources. Groundwater is a vital and threatened common resource that the PTD can and should protect.
